On the online platform MedtecLIVE (hereinafter referred to as the “Online Platform”), Providers publish their own content. Visitors can use the Online Platform to access information. Visitors may also create a free Account (hereinafter referred to as “Members”) to access additional features.
The operator of the Online Platform is MedtecLIVE GmbH (hereinafter referred to as the “Operator”). These Terms of Use govern the rights and obligations of the Operator and the Members in connection with the Online Platform. Information on data protection can be found in the data protection information.
1. Features and Services
1.1 The Operator provides the Online Platform to visitors and Members on an “as-is” basis. The available features and services depend on what is offered at the time of access, as well as any information the Operator has published regarding individual features and services. There is no entitlement to access the Online Platform or to use specific features and services.
1.2 The Operator allows visitors to create a free Account as Members. Members can use additional features of the Online Platform through their account, as described below.
1.3 Members can use various features to prepare for their trade fair visit. These include e.g. creating a bookmark list, registering for events, contacting providers and their contact persons, and receiving personalized recommendations. If available, Members or providers may scan a Member’s QR code to receive the Member’s contact details, including their email address.
1.4 If available, Members may access selected content and sections of the Online Platform that are not accessible to non-registered visitors.
1.5 Members can follow topics and providers. Based on followed topics and providers and their behavior on the Online Platform, a personalized news feed as well as personalized recommendations for the trade fair visit are generated, and personalized updates are sent via email or other communication channels. Members may opt out of these updates at any time.
1.6 Members have a public profile on the Online Platform. Members can deactivate their public profile at any time. Members with a public profile can find and see the public profiles of other Members. And their public profile can be found and seen by other members. If available, Members with public profiles can also see other public attendees of events. Providers with the respective functionality can see which Members have viewed or interacted with their content. For Members with public profiles, providers see the public profile details; for those without, only limited information without the name of the Member is shown.
1.7 Members with a public profile may send messages to other Members with public profiles. The messaging feature can be deactivated at any time, after which Members will not be able to send or receive messages.
1.8 The Operator may provide all or part of the Online Platform’s features and services via contracted or third-party providers. The Operator may modify and further develop the Online Platform or any of its individual features and services. Members will be appropriately informed of any significant changes.
2. Account
2.1 Visitors creating an Account as Members are obliged to provide complete and truthful information at all times. Registering with false or fictitious data is prohibited. The Operator is entitled – even retrospectively – to verify member data or have it verified by third parties and to request additional information from Members.
2.2 Registration is restricted to individuals with unlimited capacity to act. Members must be 18 years of age or older, unless they have the express consent of a legal representative for registration. Members are responsible for keeping their login credentials confidential and for using their Account solely themselves.
2.3 Members can delete their Account at any time under “My Account.”
3. Use
3.1 Members are obliged to use the Online Platform only as intended and in accordance with the law.
3.2 Members are obliged to only enter or publish their own content that is legally compliant, for example in their public profile or when contacting providers and other Members. Members are obliged not to publish any discriminatory, false, misleading, racist, harmful, criminal or unsafe content.
3.3 Using the Online Platform for unsolicited or otherwise impermissible advertising (“spam”) is prohibited. Sending spam to Providers or other Members is prohibited. The Operator monitors the use of the messaging function. If there is a concrete suspicion that Members are sending spam via the Online Platform, the Operator may analyze the messages and take appropriate action if necessary.
3.4 The collection or publication of content that violates intellectual property rights, personal rights or other rights of third parties is prohibited, for example images that violate the right to one's own image or the copyright of third parties. Members must assume that content from the Operator, Providers and other Members is protected by copyright and other laws.
3.5 The Operator may suspend access to the Online Platform for individual Members immediately if these Terms of Use are violated or unlawful/misuse is suspected. The Operator may issue warnings but is not obligated to do so.
3.6 Access to the Online Platform may be temporarily or partially unavailable, especially for technical reasons. The Operator may interrupt access for maintenance. While the Operator aims for high availability, no guarantees are provided.
3.7 The Operator is not obligated to monitor the conduct of Members or Providers or to pre-screen content for legality or appropriateness. The Operator accepts no liability for Member or Provider content. In cases of complaints or reports regarding potentially illegal or inappropriate content, the Operator will follow the Code of Conduct Hosting (CCH).
4. Liability
4.1 The Operator is only liable for direct damages caused by its own gross negligence or willful misconduct. Any further liability for direct damages is expressly excluded. The Operator is not liable for indirect or consequential damages, third-party claims, or lost profits. Liability for auxiliary persons is excluded.
4.2 Members are fully and unconditionally liable to the Operator and third parties – regardless of fault – for any direct or indirect costs or damages arising from violations of these Terms of Use or in connection with their use of the Online Platform. This includes indemnifying the Operator against claims from other Members or third parties and covering all related costs, including legal and court fees.
4.3 These liability limitations apply regardless of the legal basis. Any mandatory liability, particularly for gross negligence or willful misconduct and as required under applicable data protection laws, remains unaffected.
5. Final Provisions
5.1 Automated access to the Online Platform using bots, scripts, or similar means is prohibited. The Operator may allow exceptions, e.g., for API use.
5.2 The Operator may modify these Terms of Use at any time without providing reasons. Users will be appropriately informed about significant changes.
5.3 These Terms of Use are governed exclusively by the laws of Germany. The exclusive place of performance and jurisdiction is the Operator’s registered office, unless the Member is a consumer. In consumer disputes, the place of jurisdiction is the domicile or registered office of one of the parties.
